No purchase or payment of any kind is necessary to enter the contest or receive an award. A purchase will not increase your chances of being selected. Void where prohibited by law. This contest is valid in the united states only and will be governed by u.s. law. Do not enter if you are not eligible and not a legal united states resident at the time of entry.
Sponsor
The sponsor of the contest is abbott laboratories, 100 abbott park road, abbott park, il 60064 (“sponsor”), and the official administrator will be the specialized marketing group inc. (tsmgi), 775 waukegan rd. Suite 201, deerfield, il 60015 ( “administrator”).
Contest period
The contest begins at 12:00:01 a.m. U.s. eastern time (“et”) on april 19, 2025 and ends at 11:59:59 p.m. Et on december 31, 2025 (“contest period”). Additionally, consideration for individual races will be subject to an additional deadline for each race, as set forth in section 6 below.
Participant eligibility
In addition to the eligibility requirements provided elsewhere in these official rules, including section 4 below, this contest is open only to individuals referred to as “participants” (i) legally residing in the fifty (50) united states or the district of columbia, (ii) who are at least eighteen (18) years of age (19 in al/ne), as of the date of submission of their entry (defined below), and (iii) who have or can obtain legally required travel documents which would allow them to travel to the location of an award. The following are not eligible to enter or receive an award: (a) physicians, including a doctor of medicine, doctor of osteopathy, doctor of dentistry, doctor of dental surgery, doctor of podiatry, doctor of optometry, or doctor of chiropractic medicine; (b) licensed non-physician health care professionals, including a registered nurse, pharmacist, nutritionist, social worker, physical therapist, and physician's assistant; (c) non-licensed non-physicians who work in health care, including phlebotomists, technicians, and laboratory employees; (d) employees, contractors, agents, directors and officers of sponsor, and each of its affiliates, subsidiaries, and advertising and all other service agencies, including administrator, that are involved with the contest; and (e) the family members (spouse, ex-spouse, de facto spouse, child or step-child [whether nature or by adoption], parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, stepsister or 1st cousin and household member) of any individuals in (d).
To enter
All contest entries must be submitted and received before the end of the contest period to be eligible. Participant may not enter with multiple e-mail account nor may participant use any other device or artifice to register multiple times or as multiple participant. Any participant who attempts to enter under multiple identities or uses any device or artifice to enter multiple times will be disqualified and forfeits any and all awards won, in sponsor’s discretion.
Selected winners and notification
Sponsor will select winning entries, in its sole and absolute discretion, from among all eligible entries received during the contest period based on equally weighted judging criteria of (i) uniqueness, (ii) creativity, (iii) connection to health, and (iv) impact on others/community. In the event of a tie, a tie breaker will be based upon the highest score in the first judging criteria, then moving to the subsequent judging criteria, as needed to break the tie. A participant is not a recipient of any award, even if the contest should so indicate, unless and until participant’s eligibility and compliance with the official rules have been verified and participant has been notified that verification is complete. Potential wining participants will be notified by e-mail at least three (3) months prior to marathon races or at least one (1) month prior to all non-marathon races. Failure to respond to the sponsor’s request within three (3) business days after notification will result in participant forfeiting any potential award. Each potential winner is subject to verification, including verification of age and background. If a participant is found not to be eligible or not in compliance with these official rules, or if acceptance notification is returned as undeliverable, the participant will be disqualified. In the event that a participant is disqualified for any reason, sponsor reserves the right to give an award to an alternate participant who will be selected via the remaining eligible entries winner who will be selected via the judging criteria from the remaining eligible entries, even if the disqualified potential winning participant’s name may have been publicly announced. Participants may be required to sign and return within three (3) business days an affidavit of eligibility, release and indemnification, and a publicity release where allowed by law (“participant documents”) as well as an irs form 1099 (if required). If the participant documents are not returned to sponsor within the specified time period, or if participant cannot be contacted for any reason, such participant will be disqualified and an alternate participant will be selected from all remaining eligible entries received during the contest period.
If, for any reason, this contest is not capable of running as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the sponsor, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this contest, then the sponsor reserves the right at its sole discretion to cancel this contest and determine the winning participants from among all eligible entries received prior to cancellation, as set forth above.
Award details and related terms
Prizes will include entries for the following races and awarded based on eligibility, submission and races selected by participant in the registration form (each an “award”). Awards do not inlclude ay additional expenses or fees, including but not limtied to travel, accomodation, or meal expenses. Each award recipient is responsible for their own expenses.
Participants who have already successfully registered for an entry into the race for which they have applied for in this contest will be deemed ineligible to win an award for that race.
How to claim an award
Award recipients must register for the race through the respective official race registration website within 10 business days of notification as a verified contest recipient, and agree to the terms & conditions of the respective race. Sponsor shall provide registration instructions and deadlines to award recipients once they have been notified and verified according to section 4 of these official rules.
Limit: one (1) award per person
Award is non-transferrable, and no cash equivalent or substitution of award is offered, except at the sole discretion of sponsor. Travel, meals, gratuities, luggage fees, hotel charges and any other travel-related expenses are the sole responsibility of participant and are not part of the award. Award will be forfeited if participant is unable to participate in the race on designated dates. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the race organizers or any other persons providing any race or award related services. Award recipients are also responsible for obtaining travel insurance (and all other forms of insurance) at their option, and hereby acknowledge that sponsor has not and will not obtain or provide travel insurance or any other form of insurance to or for any award recipient. Lost, stolen, or damaged race materials are not the responsibility of obligation of sponsor.
By accepting an award, participant hereby grants to sponsor and its designees the right to use participant’s name, likeness, and other rights personal to participant, and participant’s entry, in connection with the contest, and for advertising, publicity and promotional purposes for sponsor throughout the universe in perpetuity in any and all media, including social media now or hereafter known, without participant’s approval or further notice or compensation to participant.
Taxes
Any valuation of the award as stated above is based on available information provided to sponsor. The value of the award may be taxable to participant as income. The participant is solely responsible for (i) all applicable federal, state, and/or local taxes, and for any fees or costs associated with the award, and (ii) reporting and paying any and all applicable taxes. Participant must provide the sponsor with valid identification and may be required to provide sponsor with a valid social security number or tax identification number before the award is awarded for tax reporting purposes. Participant is solely responsible for all federal, state and local taxes on the award and any other fees or costs associated with the award they receive, regardless of whether it, in whole or in part, is used.
Release of liability
Governing law
All issues and questions concerning the construction, validity, interpretation and enforceability of these official rules, or the rights and obligations of the participant and sponsor in connection with the contest, shall be governed by, and construed in accordance with, the laws of the state of illinois without giving effect to any choice of law or conflict of law rules.
Disputes
i. If a dispute arises between the sponsor or any participant, whether or not they are an award recipient, regarding the contest, the parties will attempt to resolve such dispute in good faith by direct negotiation by representatives of sponsor and the participant. If such negotiation does not resolve the matter within twenty-eight (28) days after notice of the dispute is given, the matter will be resolved by the following alternative dispute resolution (“adr”) procedure.
To begin an adr proceeding, a party shall provide written notice to the other party of the issues to be resolved by adr. Within fourteen (14) days after its receipt of notice of adr, the other party may, by written notice, add additional issues to be resolved. Within twenty-one (21) days following receipt of the original adr notice, the parties shall select a mutually acceptable independent, impartial and conflicts-free neutral to preside over the proceeding. If the parties are unable to agree on a mutually acceptable neutral within such period, each party will select one independent, impartial and conflicts-free neutral and those two neutrals will select a third independent, impartial and conflicts-free neutral within ten (10) days thereafter. None of the neutrals selected may be current or former employees, officers or directors of sponsor or its affiliated or subsidiary companies, or family, friends, or acquaintances of participant. The parties shall convene in a location mutually agreed upon to conduct a hearing before the neutral(s) no later than fifty-six (56) days after selection of the neutral(s) (unless otherwise agreed upon by the parties).
The adr process shall include a pre-hearing exchange of exhibits and summary of witness testimony upon which each party is relying, proposed rulings and remedies on each issue, and a brief in support of each party’s proposed rulings and remedies not to exceed twenty (20) pages. The pre-hearing exchange must be completed no later than ten (10) days prior to the hearing date. Any disputes relating to the pre-hearing exchange shall be resolved by the neutral(s). No discovery shall be permitted by any means, including depositions, interrogatories, requests for admissions, or production of documents.
The hearing shall be conducted on two (2) consecutive days, with each party entitled to five (5) hours of hearing time to present its case, including cross-examination. The neutral(s) shall adopt in its entirety the proposed ruling and remedy of one of the parties on each disputed issue but may adopt one party’s proposed rulings and remedies on some issues and the other party’s proposed rulings and remedies on other issues. The neutral(s) shall rule within fourteen (14) days of the hearing, shall not issue any written opinion, and shall not refer any portion of the dispute to mediation without the parties prior, written consent. The rulings of the neutral(s) shall be binding and non-appealable and may be entered as a final judgment in any court having jurisdiction.
The neutral(s) shall be paid a reasonable fee plus expenses. These fees and expenses, along with the reasonable legal fees and expenses of the prevailing party (including all expert witness fees and expenses), the fees and expenses of a court reporter, and any expenses for a hearing room, shall be paid as follows: (a) if the neutral(s) rule(s) in favor of one party on all disputed issues in the adr, the losing party shall pay 100% of such fees and expenses; and (b) if the neutral(s) rule(s) in favor of one party on some issues and the other party on other issues, the neutral(s) shall issue with the rulings a written determination as to how such fees and expenses shall be allocated between the parties. The neutral(s) shall allocate fees and expenses in a way that bears a reasonable relationship to the outcome of the adr, with the party prevailing on more issues, or on issues of greater value or gravity, recovering a relatively larger share of its legal fees and expenses.
ii. The arbitration of disputes pursuant to this section shall be in the participant’s individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated. Do not enter this contest if you do not agree to have any claim or controversy arbitrated in accordance with these official rules.
iii. By participating in the contest, each participant agrees that to the extent permitted by applicable law: (1) any and all disputes, claims and causes of action arising out of or connected with the contest, or any award, will be resolved individually without resort to any form of class action; (2) under no circumstances will any participant be permitted to obtain (i) any recovery for, and participant hereby knowingly and expressly waives all rights to seek, punitive, incidental, consequential or special damages, lost profits and/or any other damages, other than actual out of pocket expenses), and/or (ii) any rights to have damages multiplied or otherwise increased; and (4) participant 's remedies are limited to a claim for money damages (if any) and participant irrevocably waives any right to seek injunctive or equitable relief. Some jurisdictions do not allow the limitations or exclusion of liability, so the above may not apply to every participant.
Privacy
Sponsor will be collecting personal data about participant online, in accordance with its privacy policy. Please review sponsor’s privacy policy (found at https://www.abbott.com/privacy-policy). If you are selected as a winner, your information may also be included in a publicly available winner’s list.
Participant list
o obtain a winner list which is available 60 days after the winning participants of the of the contest have been announced, mail a self-addressed stamped envelope to: 775 waukegan rd ste 201, deerfield, il 60015, attn: team abbott bib contest winner’s list. Winning participant list requests must be received within 60 days of the conclusion of the contest or after winning participants have been announced.
